TERMS OF SERVICE

By creating an account and using Mirokami, you agree to these Terms of Service. If you do not agree, do not use the application.
Mirokami is currently operated by Renato Sousa (personally — not yet incorporated as a legal entity). When a legal entity is formed, these Terms will be updated to reflect the new operator.
Mirokami is a virtual character application that interacts with the world through the photos you take. The service includes:
- Creation and customization of a virtual character
- Photo-based interactions captured in-app by the camera
- Image analysis by Artificial Intelligence
- Attribute and experience system, including seasonal experience packs
- Peer encounters via in-app QR code and optional sharing to Instagram Stories
- Optional rewarded ads
3.1. Eligibility
- Minimum age: 16 years old worldwide. In Brazil this aligns with Law 15.211/2025 (Lei Felca / Digital ECA); elsewhere we apply 16+ globally as a more protective policy, in addition to any higher minimum age set by your local law
- Users between the minimum age and 18 are considered minors and receive additional protections, including non-personalized ads and no behavioral profiling
- If you are a minor, we encourage you to involve a parent or guardian
- You must provide an accurate date of birth and country at signup. Falsifying age information is a breach of these Terms
- All account information must be truthful and accurate
3.2. Responsibilities
- Maintain the security of your password
- Do not share your account with third parties
- Notify us immediately of unauthorized use
- You are responsible for all activities on your account
We verify your age at signup and may revalidate it over time:
- Self-declared date of birth and country at signup
- When available, a coarse age range provided by your operating system (Apple Declared Age Range, Google Play Age Signals)
- If signals disagree, the most restrictive one prevails
If you do not meet the minimum age for your jurisdiction, or if signals indicate you are below it, your account is suspended pending verification and may be permanently deleted
For users under 18, advertising is served as non-personalized (npa=1) and we do not use personal data for behavioral profiling or third-party marketing
You MAY:
- Use the app for personal entertainment
- Take photos of food, activities, and hobbies
- Share your experiences on social media
You MAY NOT:
- Submit illegal, offensive, or inappropriate content
- Upload photos of other people without their permission
- Upload identifiable photos of minors without their guardian's consent
- Attempt to hack, exploit bugs, or violate security
- Use bots, scripts, or unauthorized automation
- Reverse engineer the application
- Resell, redistribute, or commercialize the service
- Send spam or malicious content
- Falsify your age or circumvent the age gate
Violations: We reserve the right to suspend or terminate accounts that violate these terms, without prior notice.
6.1. Your Photos
- You retain all rights to the photos you upload
- By uploading, you grant us a license to process the images with AI to power the character experience
- We do not share your photos with third parties (except infrastructure providers like AWS for storage)
- Photos are stored privately on Amazon S3 and listed in your interaction history
- You can delete individual photos manually at any time
- Deletion is permanent and immediate — there is no trash or recovery option
- When you delete your account, all your photos are deleted within 30 days
6.2. Prohibited Content
We do not tolerate:
- Nudity or explicit sexual content
- Violence, gore, or cruelty
- Hate speech, discrimination, or harassment
- Third-party personal information without consent
- Copyright infringement
Important: Mirokami is in Alpha Phase. This means:
- The app may contain bugs and instabilities
- Features may change or be removed without notice
- Service interruptions may occur
- Data may be lost during updates (we'll do our best to avoid this)
- The service is provided "as is"
Currently: Mirokami is free during the Alpha phase. We do not currently offer in-app purchases or subscriptions.
Future: We may introduce:
- In-app purchases (consumables, premium items)
- Optional subscriptions
- Ad removal
You will be informed of any change before implementation.
9.1. By You
You can delete your account at any time: tap the help icon (?) → Settings → Delete Account. The deletion is confirmed via a 6-digit code sent to your email.
Deletion is permanent and removes your account, your character, interactions, and stored photos within 30 days.
9.2. By Us
We may terminate or suspend your account if:
- You violate these Terms
- Your use harms the service or other users
- Age signals indicate you do not meet the minimum age for your jurisdiction
- Required by legal authorities
- The service is discontinued
To the maximum extent permitted by law:
- The service is provided "AS IS" and "AS AVAILABLE"
- We do not guarantee that the app will always be available or error-free
- We are not responsible for loss of data, profits, or indirect damages
- Our liability is limited to the maximum extent permitted by applicable law. For users protected by the Brazilian Consumer Defense Code (CDC), our liability follows that Code regardless of any contractual cap
- These Terms are governed by the laws of Brazil
- For consumer users in Brazil, disputes may be brought before the consumer's domicile court, as guaranteed by the Brazilian Consumer Defense Code. For all other matters, the courts of São Paulo, Brazil, are competent
We may update these Terms periodically. Significant changes will be announced through an in-app notice or by email. Continued use after changes means acceptance of the updated Terms.
